1. Provider and general provisions
The provider of the services and products is the company named above (the "provider"). These terms govern the use of the website and the business relationship between the provider and the customer or website visitor. By using the website or submitting an inquiry, the customer confirms that they have read these terms and agree to them.
2. Scope of the terms
The terms apply to all inquiries, quotes, orders and contracts relating to the manufacture, supply and installation of concrete elements and related services of the provider. Any differing or additional terms of the customer are not binding on the provider unless the provider expressly confirms them in writing. Individual written agreements between the parties take precedence over these terms.
3. Use of the website
The content of the website is for information purposes only and does not constitute a binding offer. The provider strives to keep the information accurate and up to date, but does not warrant that all information (technical data, dimensions, colours, prices) is always complete and free of errors. The user undertakes not to use the website in a way that could harm its operation, security or availability, and not to carry out automated scraping of content without the provider's written permission.
4. Intellectual property rights
All content on the website, including text, photographs, illustrations, the logo, visual identity and source code, is a copyright work or subject to other intellectual property rights of the provider or its partners. Reproduction, distribution or other use of the content without the provider's prior written consent is not permitted, except for personal, non-commercial use.
5. Inquiries, quotes and formation of contract
Submitting an inquiry through the form or by email does not constitute an order and does not create any obligation for either party. Based on an inquiry, the provider prepares a quote, which is binding for the period stated in the quote; if no period is stated, it is valid for 30 days from the date of the quote. A contract is concluded when the customer confirms the quote in writing, or when the provider confirms the customer's order in writing. Email is deemed to be written form. Oral agreements are binding only if confirmed in writing.
6. Prices
Prices in the quote are stated in euros. Unless expressly stated otherwise, prices do not include value added tax, delivery, installation, site readiness works or any permits. Until a contract is concluded, the provider reserves the right to change prices. After the contract is concluded, a price change is possible only in the event of material changes in the price of materials or other input costs, and subject to prior notice to the customer.
7. Payment terms and retention of title
Payment terms are set out in the quote or contract. The provider may require an advance payment (deposit) before work begins. In the event of late payment, the provider may charge statutory default interest and withhold further work or delivery. Delivered goods remain the property of the provider until the purchase price is paid in full (retention of title).
8. Delivery times and performance
Delivery and completion times are indicative, unless the contract expressly defines them as fixed. The period begins to run after the contract is concluded, any advance payment is received, and all information required for performance (dimensions, drawings, sample approval) is received. The provider is not liable for delays caused by force majeure or circumstances beyond its control, for example supply chain disruptions, weather conditions, acts of third parties, or inadequate site readiness on the customer's side.
9. Warranty for defects and complaints
The provider warrants against material defects in accordance with the Obligations Code, and for consumers in accordance with the Consumer Protection Act. The customer must report obvious defects immediately on handover, and hidden defects without delay after discovery, by written notice containing a description of the defect and photographs. Complaints are accepted at the email address stated above. Concrete is a natural material. Minor variations in colour, surface texture, porosity and shade between individual products or batches are technologically inherent and do not constitute a defect. The same applies to hairline cracks that do not affect the load-bearing capacity or usability of the element.
10. Consumers and the right of withdrawal
The provisions of the Consumer Protection Act apply to consumers. For contracts concluded at a distance or off premises, a consumer generally has the right to withdraw from the contract within 14 days without giving a reason. This right does not apply to goods made to the consumer's precise specifications and tailored to their personal needs (for example, custom-made concrete elements), in accordance with the statutory exception. Consumers' statutory rights arising from the warranty for defects are not limited by these terms.
11. Limitation of liability
The provider is liable for damage caused to the customer intentionally or through gross negligence. For slight negligence, the provider's liability is limited to foreseeable direct damage and up to the value of the transaction. The provider is not liable for indirect damage, lost profit, loss of production or other consequential costs. These limitations do not apply to liability for personal injury or death, or to cases where liability cannot be limited under mandatory law. The provider is not liable for damage due to incorrect installation, use or maintenance of the elements where the installation was not carried out by the provider.
12. Personal data protection
The provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Slovenian Personal Data Protection Act (ZVOP-2). Details of the categories of data, purposes, legal bases, retention periods and rights of individuals are described in the privacy policy published on this website.
Privacy Policy13. Dispute resolution and governing law
These relationships are governed by the law of the Republic of Slovenia, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The parties will endeavour to resolve any disagreements amicably. If this is not possible, disputes between the provider and a customer who is not a consumer fall under the jurisdiction of the competent court at the provider's registered seat. For disputes with consumers, jurisdiction is determined by law. The provider does not recognise any out-of-court consumer dispute resolution body as competent to resolve a consumer dispute that a consumer could bring under the act governing out-of-court resolution of consumer disputes.
14. Changes to the terms and final provisions
The provider may amend or supplement these terms at any time. The version of the terms published at the time an inquiry is submitted or a contract is concluded applies to that relationship. If any provision of these terms is invalid or unenforceable, this does not affect the validity of the remaining provisions.
